Open Meeting Policy
Policy Overview
The Governing Board of KXNM FM 88.7, Board Committees and the Community Advisory Committee will hold Open Meetings preceded by reasonable notice to the public. Open Meetings allow all persons to attend any meeting of the board or any committee meeting.
The purpose of Board and Committee Open Meetings is to ensure transparency in the deliberations of the board and its committees. The overall intent is to unite and engage the community in providing local emergency and educational broadcasting, promoting personal development and quality of life enhancement.
What are Open Meetings?
Open Meetings that are open to the public include, but are limited to, the following:
1. Governing Board meetings:
2. Governing Board committee meetings; and
3. Community Advisory Committee (CAC) meetings
In order for a gathering of the board, committee or CAC members to constitute a meeting the following are necessary:
1. The presence of a quorum; and
2. Deliberations that determine or result in the joint conduct or disposition of business relating to public broadcasting.
Access to Open Meetings
KXNM allows anyone to attend any Open Meeting (or any portion of a meeting that is open) without requiring the person to register, or provide his or her name or any information. An exception may be required to ensure a safe meeting environment.
Notice of Open Meetings
The station will provide the public with at least a seven day notice of an Open Meeting including the time and place of the meeting, by:
And by broadcasting an on-air announcement for three consecutive days during each calendar quarter that:
KXNM will provide a copy of any Open Meeting Notice to any individual who requests it by U.S. mail, facsimile, or e-mail.
What are Closed Meetings?
KXNM will hold Closed Meetings, or close an Open Meeting, when discussing any of the following:
KXNM will provide a written statement to the public explaining the reasons for the Closed Meeting by posting those reasons on the station’s website within ten days following the Closed Meeting.

- Placing a notice in the “Legal Notices” section of The Independent, newspaper;
- Giving notice through a recorded announcement accessible on the station’s phone system (505) 886-0605.
And by broadcasting an on-air announcement for three consecutive days during each calendar quarter that:
- Explains KXNM’s Open Meeting practices; and
- Provides instructions on where the public may obtain the date, time and location of Open Meetings.
KXNM will provide a copy of any Open Meeting Notice to any individual who requests it by U.S. mail, facsimile, or e-mail.
What are Closed Meetings?
KXNM will hold Closed Meetings, or close an Open Meeting, when discussing any of the following:
- Matters concerning individual employees or volunteers.
- Proprietary information;
- Litigation or other matters requiring confidential advice of counsel;
- Commercial or financial information obtained from a person on a privileged or confidential basis; or
- The purchase of property or services, if the premature disclosure of the transaction would compromise the station’s business interests.
KXNM will provide a written statement to the public explaining the reasons for the Closed Meeting by posting those reasons on the station’s website within ten days following the Closed Meeting.
